The person granting it is the principal, the person holding it is the agent. In Dubai, a power of attorney only works once it is notarised, because that is what a bank, Dubai Land Department, the RTA or a free zone registry checks before it accepts a document signed by an agent. Some POAs are broad, covering several areas of a person’s affairs. Most are written for one task only, such as selling a property, registering a vehicle or representing a company at one meeting. The type you need depends on what the agent must do. A bank or registry reads only what is on the page. 03 The scope What the agent may do, and what is excluded. 04 An expiry or a condition, where used Many POAs run until revoked. Some are written to end on a date or after one task. 05 Signatures The principal’s signature, witnessed and notarised. A corporate principal signs through whoever the licence or a resolution names. ## Getting the scope right A power of attorney written too broadly is harder for a bank or registry to accept, because the reader cannot see what it was for. One written too narrowly for a task can leave the agent unable to finish it, if a related step was left out. We read what the agent actually has to do and write the scope to match it, rather than defaulting to a standard clause. The agent can be a family member, a business partner, a lawyer or anyone else the principal trusts, named by their passport or Emirates ID. A company grants one through whoever its licence or a resolution names as authorised to sign. - The principal must be able to understand what they are signing - The agent is named specifically, not left as “a representative” - A corporate principal signs through its authorised signatory ## Who signs, and what we check The principal, or their own attorney where permitted The agent, where the POA requires their signature too Passport or Emirates ID for both The document the POA relates to, such as a title deed or Mulkiya A corporate principal’s trade licence and authorised signatory The receiving authority’s own format, where one is specified ## Where a power of attorney is refused A power of attorney is usually refused for a narrow reason. The scope does not name the property, the vehicle or the account specifically enough. The document is older than the receiving bank or authority accepts. Or the principal’s capacity is not clear, for instance after a change the authority was never told about. We check the scope and the paperwork before you sign, not after a registry sends it back. ## Common problems, and the fix 01 The scope is too broad or too vague Fix: write what the agent will actually do, specifically. 02 No chassis or plate number, or no title deed number Fix: name the asset exactly, before you sign. 03 The POA is more than a few months old Fix: ask the receiving bank or authority what they accept, and renew if needed. 04 A corporate principal has no proof of signing authority Fix: bring the trade licence and the resolution naming the signatory. A general POA covers several matters. A special POA is written for one task and ends once it is done. #### Can a power of attorney be used outside the UAE?
