The terms on which we work
Short, because the important parts are short. Read the first two sections even if you read nothing else.
A document services provider, not a notary
Dubai Notary Services drafts corporate and estate documents in Arabic and English and arranges their notarisation before a Dubai Courts notary. We hold a trade licence for document services and notarisation support.
We are not a notary and we hold no appointment as one. The notarial act is performed by a Dubai Courts notary, in his office, under his authority. We do not act in his name, we are not agents of Dubai Courts, and we are not the notary public’s office.
We are not a law firm and we do not give legal advice. Where a matter requires legal advice we will say so.
What we do for you
When you instruct us we will: read the draft you send, or draft the instrument you describe; check it against what the receiving authority will accept as far as that is known to us; tell you who must attend and what they must bring; arrange the appointment before a Dubai Courts notary; attend it with you; and tell you what, if anything, has to happen next.
You approve the text of every instrument before it is presented for notarisation. What the instrument says, and whether it achieves what you intend, is confirmed by you at that point.
What you pay, and to whom
Our fees are published on this site and are confirmed to you in writing before work starts. They cover drafting, checking and attendance as described for the instrument concerned.
The Dubai Courts fee is set by the Courts, not by us. It is collected by us at the appointment and passed on at cost. Fees charged by any other body, such as a ministry or a diplomatic mission for a document going abroad, are those bodies’ own and are passed on at cost.
The first reading of a draft, and the first conversation, are not charged.
Fees may vary with the nature of a document and its requirements. Where a fee differs from the published figure, you will be told before work starts.
What we need from you
Accurate information about the document, the parties and where it will be used. Original identity documents at the appointment. The constitutional documents of any company involved, with every amendment. Attendance by every signatory the notary requires, at the appointed time.
Where a document is refused because information given to us was incomplete or inaccurate, the cost of a further attendance is yours.
If a document is refused
If a defect is found before the appointment, we correct it and no further charge arises for the correction.
If the notary declines to proceed at the appointment, we establish the reason and rebook. Where the reason lies in our drafting, the further attendance is at our cost. Where it lies in information not given to us, or in a requirement that could not have been known, it is at yours, and we will tell you which before rebooking.
Whether a bank, a registry or a foreign authority accepts a notarised document is that body’s decision. We do not warrant acceptance by a third party. What we undertake is that the document will be drafted so that they have no reason, known to us, to refuse it.
Limits, and which law applies
Our liability in respect of any matter is limited to the fees paid to us for that matter. We are not liable for loss arising from the decision of a notary, a bank, a registry or any other body, or from information given to us that was incomplete or inaccurate.
These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai have jurisdiction.
