FTA Power of Attorney for Tax Matters

An FTA power of attorney lets a company or owner authorise a named person to deal with the Federal Tax Authority for them. We draft it in Arabic and English and notarise it at our Business Bay office.

What an FTA power of attorney does

Someone has to register the company for tax, file its returns and answer the Federal Tax Authority. When that person is not the owner or the signatory on the trade licence, the FTA can ask for proof that they are authorised. A notarised power of attorney is one common form of that proof.

The power names the company, the person acting and the tax matters they may handle. It can cover VAT, corporate tax, excise tax, or only one of them. Keep it to what the person actually needs to do.

Check the FTA’s current requirements for your case before signing. If you are unsure, call or WhatsApp us.

What the document must contain

01

The company

Its name and legal form exactly as on the trade licence, with the licence number.

02

The Tax Registration Number

If the company already has one.

03

The person acting

Full name, nationality and passport or Emirates ID number.

04

The tax matters

Each tax and each act named, such as registration, returns or deregistration.

05

Term and delegation

An end date if you want one, and whether the person may delegate.

Getting the scope right

Name the taxes and the acts. “Deal with tax matters” is thin. “Register the company for VAT and corporate tax, file returns and reply to FTA letters” is clear. Leave out what the person should not do, such as signing contracts or moving money.

Where it is refused, and why

An FTA power of attorney runs into trouble when the signatory has no clear authority, when the company name does not match the licence, or when the act needed is not listed. A power signed abroad without attestation is also a problem. Each can be checked before signing.

Rejection reasons, and the fix

01

The act is not listed

Fix: name each tax and each act.

02

The signatory has no authority

Fix: cite the MOA clause or add a resolution.

03

The company name does not match

Fix: copy it from the trade licence, legal form included.

04

The ID details are wrong

Fix: copy them from the passport or Emirates ID.

05

Signed abroad, not attested

Fix: attestation in that country, including the UAE embassy, then MOFAIC in the UAE.

After notarisation

01

Keep the notarised original safe

The person acting may need to show or upload it.

02

Upload a copy where asked

The FTA’s online system may ask for proof of authority when the person acts.

03

Update it when people change

If the person acting leaves, revoke the power and grant a new one.

04

Signed outside the UAE

Grant it online with our in-house notary public, who checks your identity and witnesses the signing by video. Signed before a notary abroad instead: attestation there, then MOFAIC in the UAE. The UAE does not use apostilles.

A tall stack of printed pages

Revocation and changes

A power of attorney is not edited. If the person or the scope changes, a new power is drafted and the old one is revoked by its own notarised document. Update the tax record so it shows the right person.

Questions about an FTA power of attorney

Does the FTA need a notarised power of attorney?

When someone other than the owner or licence signatory acts, the FTA can ask for proof of authority. A notarised power is a common form of it. Check the FTA’s current requirements for your case.

Is it the same as hiring a tax agent?

No. A tax agent acts under an agreement with you. A power of attorney authorises your own person.

Can one power cover VAT and corporate tax?

Yes, if both are named.

Can a free zone company use it?

Yes. The company name and licence details must match the free zone licence.

How long does it last?

There is no fixed legal validity period. The term is what the document says.

Can I sign it without coming to the office?

Yes. We offer online notary public services and home visit notary services. Call or WhatsApp to book.

A band is fine. A guessed date is worse than no date.
In the UAE, at a named bank or registry, or in another country. This changes what has to happen after notarisation.
